Cyber Cops Wrestle With Legal Hurdles, Public Perception | threatpost

CANCUN, MEXICO -- A panel of top law enforcement officers in charge of cyber criminal investigations reveals that the guys with the white hats face an uphill climb if they want to take down cyber criminal kingpins, with outdated laws and processes on the one hand, and an increasingly skeptical and privacy-conscious public on the other.

The advent of social media has made it easier than ever to find information about cyber criminals online, the cyber crime investigators said. But a lack of enforceable cross-border laws and procedures to obtain information about suspects and bring them to justice still makes it easy for cyber criminals to evade detection, the panelists agreed.

The gathering, at Kaspersky Lab's annual Security Analyst Summit, featured senior officials and cyber investigators from Interpol, the Dutch High Tech Crime Unit, Germany's Bundeskriminalamt (BKA), and the General Directorate for the Romanian Intelligence and Internal Protection (GDIIP).

Too many cyber criminal investigations suffer for a lack of effective international cooperation, or from legal tools that have failed to keep pace with the blistering pace of technological change, the participants agreed.

Detective Sergeant Michael Moran, the Acting Assistant Director of Cyber Security and Crime in Interpol's Global Complex for Innovation (IGCI), cited the continued reliance, between law enforcement within Europe, on the Mutual Legal Assistance Treaty as a stumbling block.

"These are inquiries that can take months or even years to complete," Moran said. That's a problem when data retention policies at ISPs and firms offering online services may only hold onto potentially incriminating data for months at a time. "These are issues facing law enforcement on a daily basis, and there's a great deal of frustration involved," Moran said.

But the increased demand for cyber criminal investigative tools also comes with risks. The past year has seen controversy over the German government's use of a Trojan horse program to monitor criminal suspects, a UK company's work to enable the former Egyptian government of Hosnei Mubarak to spy on its citizens, and more recent questions about the FBI's possible use of Trojans to monitor the communications of Megaupload chief Kim DotCom.?

Audience members at the annual conference, many of whom were security researchers and IT professionals, raised questions about the ethics of using "hacker tools" as part of criminal investigations, and about the limits of both monitoring and international agreements to expedite cyber criminal investigations.

Panel members defended the practice, while also admitting that there need to be careful checks and balances to protect privacy and civil liberties. Frank Schleppi, a Detective Seargent Germany?s Bundeskriminalamt (BKA) said that German law applies different standards to different types of surveillance techniques, making some relatively easy to deploy as part of a criminal investigation, and others nearly impossible.

Peter Zinn, a Senior Cybercrime Advisor for the Dutch National High Tech Crime Unit, said the same was true for his agency, and said authorities would benefit from fewer barriers to sharing information with law enforcement in other countries.

Speaking of his agency's success in shutting down global botnets such as Bredolab, Zinn defended that agency's use of the captured botnet to inform victims and help them to disinfect their systems.

The growing use of social media by online criminals is also aiding investigations, Zinn said. As an example, he said that Dutch authorities were able to identify the operator of the Bredolab botnet after he allowed his girlfriend to post to her Facebook profile from his laptop. Authorities were then able to mine public information about him and his movements and finally apprehend the suspected botmaster, a 27 year old Armenian man identified as "Gregory A." with the help of authorities in Armenia in October, 2010, Zinn said.

Social media tools such as Flickr and Google maps are also proving to be critical tools in pursuing formerly "victimless" crimes like child pornography, Zinn said. He said Dutch authorities had compiled an image database of 233,000 illicit images, many taken from underground Tor Network sites frequented by child pornographers. That image database can be mined for visual clues in images to help locate both perpetrators and victims of child sexual abuse, Zinn said.

UK retailer withdraws Transformer Prime, blames 'faults' and stock availability

British retailer Clove Technology has taken the ASUS Transformer Prime off sale today, saying "faults" reported by customers and difficulty in obtaining stock are behind the decision.

In a post on its official blog, Clove says stock levels have been a "real issue", and despite being able to obtain some Transformer Prime units earlier than expected, it's decided to withdraw the tablet from sale due to complaints of faults in some units.

The news will come as a blow to ASUS, which has already seen the Transformer Prime's launch tainted by poor availability and reports of GPS and Wifi issues in some units. ASUS has insisted that none of the Transformer Prime models sold in the UK are affected, so it's particularly surprising to see a UK retailer pulling the device from sale for this reason. It's also worth noting that Clove is the first retailer to take such a drastic step, and that the Prime remains on sale at other outlets.

Great Books for Kids and Teens: Middle-Grade Review: Wonderstruck

I somehow missed out on all the excitement surrounding Brian Selznick?s first award-winning novel, The Invention of Hugo Cabret.? I heard a lot about it but never had a chance to read it.? So, when I heard last year that Selznick had published another groundbreaking, amazing novel, I was determined not to miss it this time.? I recently finished his latest masterpiece, Wonderstruck, and now I know what all the fuss is about.? This one-of-a-kind book completely captivated me.

Wonderstruck is not just a unique story but a wholly unique way of telling a story.? The book contains two different but intersecting stories, each told in a different way.? First, we are introduced to Ben, a young boy growing up in northern Minnesota in the 1970?s.? Ben?s story is told in a somewhat traditional way, through text, as Ben reminisces about his mother and tries to adjust to her recent death.? With his mother now gone, Ben also begins to wonder about his father, an unknown man his mother never identified.

The second story in the book is told entirely through pictures.? The reader is introduced to Rose, a young girl living in Hoboken, New Jersey, in 1927, through gorgeous, full-page pencil drawings showing her in her room, overlooking New York City across the water, as she works on her scrapbook of a famous actress.? The book then alternates between Ben?s story, told in text, and Rose?s story, told in drawings.? The two children?s stories parallel each other right from the start, as both of them set out on a personal mission to find something missing from their lives.? I love that kind of? symmetry and serendipity in a story.

This unique book fully engages the reader, pulling you into the compelling stories of both Ben and Rose.? I found myself rubbing my hands over the beautiful embossed cover of the book and the smooth, exquisitely detailed pencil drawings.? It?s amazing how fully Selznick can tell Rose?s story entirely through pictures, a feat that takes on an even greater significance as you learn more about Rose?s life.? And the prose describing Ben?s adventures is equally mesmerizing.

I?ve heard some people somewhat put off by the size of this hefty novel.? At over 600 pages, it is a brick of a book, but I read it very quickly, over the course of just two days, since more than half of the pages are filled with illustrations.? And while those wonderful drawings do entice you to linger, the story keeps you turning the pages to see what will happen to Ben and Rose and how ? and if ? their stories will intersect at some point.? The title is apt; this novel will leave you wonderstruck.? I can?t wait to see what Selznick comes up with next?and I think I need to go back and read The Invention of Hugo Cabret, too.

Exxon narrowly beats, but production falls short (Reuters)

(Reuters) ? Exxon Mobil Corp reported quarterly earnings that narrowly beat expectations, on higher oil prices and asset sales of about $1 billion, but the company's shares dropped nearly 2 percent as its oil and gas production fell short of estimates.

Exxon, the world's largest publicly traded oil company, said fourth-quarter production dropped 9 percent, which Barclays Capital analyst Paul Cheng found "disappointing" even after accounting for reduced European natural gas sales due to warm weather.

"There's no strong evidence that the portfolio is delivering the capability to grow and frankly, based on our preliminary take, it looks like costs are going the wrong way," said Mark Gilman, analyst at The Benchmark Company. "There's not a lot to smile about."

While 2011 output rose 1 percent, this was all natural gas as the production of more lucrative liquids declined. Plus, Exxon's capital expenditures rose to a record $36.8 billion, the top of the range of its multi-year forecast, and oilfield spending generally is expected to increase further this year.

"We are in a capex mode now and have been for the last year or two, and will for the next couple years be investing in large legacy projects," Exxon spokesman David Rosenthal told analysts on a conference call.

Spending billions just to maintain steady output has become the norm for the world's top oil companies. Chevron Corp increased its 2012 capital spending plans to $32.7 billion after its 2011 budget came in $3 billion higher than originally expected.

Yet in spite of weak U.S. natural gas prices, Irving, Texas-based Exxon has not curtailed domestic gas production, even if it is shifting rigs to basins with more liquids.

Exxon posted fourth-quarter net income of $9.4 billion, or $1.97 per share, compared with $9.25 billion, or $1.85 per share, in the year-ago period. Analysts, on average, had expected $1.96 per share, according to Thomson Reuters I/B/E/S. Analysts lowered their expectations by a few cents in the past week.

The quarterly profit was Exxon's lowest for 2011.

Exxon's revenue rose 16 percent to $121.61 billion, exceeding the $119.7 billion expected, on average, by analysts.

The company's Canadian subsidiary, Imperial Oil Ltd, on Tuesday reported a 26 percent increase in profit, on higher crude prices and an improved refining performance.

Rising oil prices also helped lift Exxon Mobil's profits at its upstream unit, which produces oil and natural gas, by 18 percent. Land sales contributed to earnings, it said.

Still, weak economic conditions hurt Exxon's margins. Profit at its downstream unit, which makes engine lubricant and fuel, fell 13 percent. Profit at its chemical unit, which makes plastics and related products, declined 49 percent.

Exxon spent $10 billion during the quarter on capital projects and exploration, in line with the same period in 2010.

Shares of Exxon were down 1.8 percent at $83.95 in afternoon trading on the New York Stock Exchange.

Taking the long view on the world's energy supplies

BACK in 1896, the Swedish scientist Svante Arrhenius realised that by burning coal we were adding carbon dioxide to the air, and that this would warm the Earth. But he mentioned the issue only in passing, for his calculations suggested it would not become a problem for thousands of years. Others thought that the oceans would soak up any extra CO₂, so there was nothing much to worry about.

That this latter argument has persisted to this day in some quarters highlights our species' propensity to underestimate the scale of our impact on the planet. Even the Earth's vast oceans cannot suck up CO₂ as quickly as we can produce it, and we now know the stored CO₂ is acidifying the oceans, a problem in itself.

Now a handful of researchers are warning that energy sources we normally think of as innocuous could affect the planet's climate too. If we start to extract immense amounts of power from the wind, for instance, it will have an impact on how warmth and water move around the planet, and thus on temperatures and rainfall (see "How clean is green?").

Just to be clear, no one is suggesting we should stop building wind farms on the basis of this risk. Aside from the huge uncertainties about the climatic effects of extracting power from the wind, our present and near-term usage is far too tiny to make any difference. For the moment, any negative consequences on the climate are massively outweighed by the effects of pumping out ever more CO₂. That poses by far the greater environmental threat; weaning ourselves off fossil fuels should remain the priority.

Even so, now is the time to start thinking about the long-term effects of the alternative energy sources we are turning to. Those who have already started to look at these issues report weary, indifferent or even hostile reactions to their work.

That's understandable, but disappointing. These effects may be inconsequential, in which case all that will have been wasted is some research time that may well yield interesting insights anyway. Or they may turn out to be sharply negative, in which case the more notice we have, the better. It would be unfortunate, to put it mildly, to spend countless trillions replacing fossil-fuel energy infrastructure only to discover that its successor is also more damaging than it need be.

These climatic effects may even be beneficial. The first, tentative models suggest that extracting large amounts of energy from high-altitude jet streams would cool the planet, counteracting the effects of rising greenhouse gases. It might even be possible to build an energy infrastructure that gives us a degree of control over the weather: turning off wind turbines here, capturing more of the sun's energy there.

We may also need to rethink our long-term research priorities. The sun is ultimately the only source of energy that doesn't end up altering the planet's energy balance. So the best bet might be to invest heavily in improving solar technology and and energy storage - rather than in efforts to harness, say, nuclear fusion.

For the moment, all of this remains supposition. But our species has a tendency to myopia. We have nothing to lose, and everything to gain, by taking the long view for a change.
